Judge Gives the Justice Dept. A Class Assignment

Judge Jerry Smith, a member of the 5th Circuit since President Reagan appointed him in 1988, is no shrinking violet. But his bold move this week was to spar with President Barack Obama over his remarks at a news conference.

Can you believe a federal appellate judge gave the U. S. Justice Dept. the task of producing a three page single spaced report to reassure the court that the Obama Administration respects the decisions the courts make. Judge Jerry Smith made the request after President Barack Obama said this week that it would be "unprecedented" for the Supreme Court to overturn a major law passed by Congress like the health care overhaul whose constitutionality it is now considering. Smith directed the Justice Dept. to specifically address the President's remarks.

Attorney General Eric Holder on Thursday offered written assurances that the Obama administration respects the decisions that courts make. His response was "under three pages".

It's pretty amusing how the political right, which for years has chastised "activist" federal judges for disregarding the will of the people and their elected representatives -- John Cornyn? George H.W. Bush? Mitt Romney? You can look it up -- now hyperventilates when Obama throws their rhetoric back at them...
...It's too preposterous to imagine Antonin Scalia, Clarence Thomas or even Ruth Bader Ginsburg quaking before even the world's most powerful elected official. They have life tenure; he can get voted out.

When all is said and done, the Supreme Court will issue its ruling on Obamacare.  Those who agree with the ruling will praise the court and those that disagree will berate them. Hopefully, President Obama will make additional judical appointments during his second term, including another Supreme Court justice.
